Kansas Secretary of State Kris Kobach, a prominent advocate of stringent immigration policies, lamented three Kansas Supreme Court decisions concerning identity theft.
The decisions reversed identity theft convictions for Donaldo Morales, Guadalupe Ochoa-Lara and Ramiro Garcia on the grounds that federal immigration law pre-empts the state’s ability to prosecute them. Kobach, whom many consider to be the front-runner for the Republican gubernatorial nomination, found fault with the decision in a Facebook post.

“Unfortunately, these decisions now mean that illegal aliens who steal social security numbers and work in Kansas cannot be prosecuted,” Kobach said. “This is yet another respect in which Kansas is becoming the sanctuary state of the Midwest.”
Kobach’s office did not immediately return a request Thursday for comment asking him to elaborate
